These Terms and Conditions govern the use of OUTLEARNING’s website, digital platforms, educational programmes, bookings, and related services. By using our website or confirming a booking with OUTLEARNING, you agree to these Terms and Conditions.
1. About OUTLEARNING
OUTLEARNING is an educational experiences company that designs, coordinates and facilitates experiential learning programmes for schools, educational institutions, teachers, learners, parents and organisations. Our services may include, but are not limited to:
- Career guidance tours
- University and college visits
- Industry and workplace visits
- Educational excursions
- STEM and innovation programmes
- Leadership camps
- Cultural and heritage experiences
- Environmental education
- Teacher development programmes
- Skills development workshops
- Educational travel within and outside South Africa
- Digital learning resources and educational content
2. Website Information
We strive to ensure that all information published on our website, brochures, social media platforms and promotional material is accurate and up to date. Programme availability, prices, schedules, venues and activities may change without notice due to operational requirements or changes by our partner institutions. OUTLEARNING reserves the right to correct errors, amend programme details or withdraw any offering where necessary.
3. Programme Bookings
A booking is only confirmed once:
- The required booking form has been completed;
- The required deposit or full payment has been received;
- Outlearning has issued written confirmation.
Quotations remain valid only for the period stated on the quotation. Programme availability cannot be guaranteed until confirmation has been issued.
4. Pricing
Unless otherwise stated, all prices are quoted per learner or participant. Programme prices may include some or all of the following:
- Educational activities;
- Entry fees;
- Learning materials;
- Transport;
- Accommodation;
- Meals;
- Facilitator costs;
- Programme coordination.
The quotation supplied to the client will specify what is included and excluded. Prices may change before confirmation due to supplier increases, fuel costs, exchange rate fluctuations or changes beyond our control.
5. Payment Terms
Payment schedules will be communicated on each quotation or invoice. OUTLEARNING reserves the right to cancel or postpone bookings where payments are not received by the required dates.
Late payments may result in cancellation of bookings or the release of reserved spaces. Any banking charges remain the responsibility of the client.
6. Schools’ Responsibilities
Schools remain responsible for:
- Providing accurate learner and educator information;
- Ensuring all required parental consent forms are completed;
- Informing outlearning of medical conditions, allergies or disabilities;
- Ensuring learners comply with programme rules;
- Providing adequate supervision throughout the programme unless otherwise agreed.
Schools must ensure learner information supplied is accurate. OUTLEARNING shall not be liable for problems resulting from incorrect information supplied by the school.
7. Parents and Guardians
Where parents book directly with OUTLEARNING, they accept responsibility for:
- Providing accurate participant information;
- Making payments on time;
- Informing outlearning of medical conditions;
- Ensuring participants comply with programme rules.
8. Learner Conduct
All learners are expected to:
- Behave respectfully;
- Follow instructions from educators and facilitators;
- Respect property belonging to venues and partners;
- Avoid behaviour that places themselves or others at risk.
OUTLEARNING reserves the right to remove any participant whose behaviour is unsafe, disruptive or unlawful. Any costs resulting from deliberate damage or misconduct may be recovered from the school or parent.
9. Teacher Supervision
Teachers remain responsible for learner discipline and welfare throughout the programme. OUTLEARNING staff coordinate programme activities but do not replace the school’s duty of care. Minimum supervision ratios remain the responsibility of the participating school.
10. Health and Medical Information
Schools and participants must disclose any medical conditions, allergies, disabilities or dietary requirements before the programme. OUTLEARNING will make reasonable efforts to accommodate disclosed needs but cannot guarantee that every request can be fulfilled. Participants requiring medication remain responsible for bringing and managing their prescribed medication unless alternative arrangements have been agreed.
In the event of a medical emergency, OUTLEARNING may seek appropriate medical assistance. Any medical costs incurred remain the responsibility of the participant, parent or school unless otherwise covered by insurance.
11. Transport
Where transport forms part of the programme, OUTLEARNING will make use of approved transport providers.
Departure times must be observed. Programme schedules may change due to traffic, weather, road closures or other unforeseen circumstances. OUTLEARNING shall not be liable for delays beyond its reasonable control.
12. Accommodation
Where accommodation is included, participants agree to comply with the rules of the accommodation provider. Any damages caused by participants may be charged to the responsible school or parent. Room allocations remain subject to operational requirements.
13. Programme Changes
OUTLEARNING reserves the right to substitute:
- Venues;
- Presenters;
- Facilitators;
- Transport providers;
- Accommodation;
- Activities;
Where circumstances beyond our control require such changes. Any substitutions will, where reasonably possible, provide a similar educational experience.
14. Photography and Media
Photographs and videos may be captured during programmes for educational, reporting and promotional purposes. Schools are responsible for informing OUTLEARNING in writing before the programme if any learner may not appear in photographs or videos. OUTLEARNING will respect reasonable requests relating to image use.
15. Intellectual Property
All educational materials, learning resources, lesson plans, digital content, graphics, videos, photographs, trademarks, logos and website content remain the intellectual property of OUTLEARNING unless otherwise stated. No material may be reproduced, copied or distributed without written permission.
16. Cancellations
Cancellation requests must be submitted in writing. Cancellation charges may apply depending on:
- Notice period;
- Supplier commitments;
- Accommodation bookings;
- Transport bookings;
- Venue policies.
Deposits may be non-refundable where costs have already been incurred.
17. Refunds
Approved refunds will be processed after receiving any applicable refunds from third-party suppliers. Administrative charges and supplier cancellation fees may be deducted. Refund processing times may vary depending on suppliers and financial institutions.
18. Third-Party Service Providers
OUTLEARNING works with a network of educational institutions, universities, museums, hospitals, businesses, transport companies, accommodation providers and activity operators.
While reasonable care is taken in selecting partners, OUTLEARNING cannot be held responsible for the acts, omissions or operational failures of independent third-party providers.
19. Force Majeure
OUTLEARNING shall not be liable for failure or delay in providing services due to events beyond its reasonable control, including but not limited to:
- Severe weather;
- Floods;
- Fires;
- Strikes;
- Pandemics;
- Government restrictions;
- Political unrest;
- Natural disasters;
- Venue closures;
- Transport disruptions.
Where practical, OUTLEARNING will make reasonable efforts to reschedule affected programmes.
20. Limitation of Liability
Participants attend programmes at their own risk. OUTLEARNING will exercise reasonable care in planning and coordinating educational experiences.
To the fullest extent permitted by law, OUTLEARNING shall not be liable for indirect, incidental or consequential losses arising from participation in its programmes. Nothing in these Terms excludes liability where such exclusion is prohibited by law.
21. Child Protection
OUTLEARNING is committed to creating safe, respectful and inclusive learning environments. All staff, facilitators and partners are expected to uphold professional standards when interacting with learners.
Any safeguarding concerns should be reported immediately to OUTLEARNING.
22. Privacy
OUTLEARNING respects your privacy. Personal information is collected only for programme administration, communication, safety and legal compliance.
Information will not be sold or shared except where necessary to deliver programme services or where required by law. OUTLEARNING complies with applicable data protection legislation, including the Protection of Personal Information Act (POPIA) in South Africa and other applicable privacy laws.
23. Website Use
Users agree not to:
- misuse the website;
- Upload malicious software;
- Attempt unauthorised access;
- Copy website content without permission;
- Interfere with website functionality.
OUTLEARNING reserves the right to suspend access where misuse occurs.
24. Governing Law
These Terms and Conditions shall be governed by the laws of the Republic of South Africa unless otherwise agreed in writing. Any disputes shall first be addressed through good-faith negotiation before either party institutes legal proceedings.
